ON THE ISSUE OF THE PRACTICAL IMPLEMENTATION OF THE LEGAL NORM ON THE ELECTION OF MAGISTRATES BY THE POPULATION

Exploring the possibility of applying in practice a legal norm that establishes the possibility of electing magistrates by the population of the relevant judicial district, the author analyzes the legislatively fixed elements of the legal status of judges of the Russian Federation and the principles of Russian electoral law. Despite the apparent democracy of the provision under consideration on the participation of the population in the formation of the judiciary, it is concluded that this norm contradicts both the basic principles that together constitute the status of servants of Themis and the fundamental principles of electoral law and the electoral process of the Russian Federation.
