Roszczenie o wynagrodzenie za bezumowne korzystanie z rzeczy lub prawa za okres poprzedzający zasiedzenie własności rzeczy lub służebności (art.224, 225 k.c.).

The article takes a position on the issue which raises doubts in the doctrine and jurisprudence, whether the former owner of a thing, in particular real estate, may be entitled to a claim against the possessor of the thing for remuneration for non-contractual use of it (Articles 224, 225 of the Civil Code) for the period preceding the acquisition by this owner of the property by usucaption. Various positions and arguments have been presented, which on the one hand support the view that such a claim is entitled, and on the other hand, that there are no grounds for recognizing the legitimacy of this claim. A resolution of this dispute was proposed and arguments were presented that would support the recognition of the validity of the first of the above-mentioned views.
