Postanowienie o umorzeniu postępowania przygotowawczego z uwagi na niewykrycie sprawcy przestępstwa w kontekście wznowienia postępowania administracyjnego na podstawie art. 145 § 1 pkt 1 k.p.a.

This paper discusses the possibility of reopening the administrative proceedings pursuant to Article 145 par. 1 item 1 of the Code of Administrative Proceedings in connection with the decision on the discontinuation of the preliminary proceedings in the criminal case due to the failure to identify the perpetrator pursuant to Article 322 par. 1 of the Code of Penal Proceedings. This paper concisely presentsthe essence of reopening the administrative proceedings because of declaring the evidence – on the basis of which the factual circumstances relevant to the case were established – as false, elaborating on the notion of evidence and relevance of such circumstances, as well as the procedural significance of the aforementioned decision on the discontinuation of the preliminary proceedings. Furthermore, this paper analyses the judicial decision of the WSA (Voivodeship Administrative Court) and NSA (Supreme Administrative Court) concerning the recognition of the said decision on discontinuation as a decision of another body, confirming the falsification of the evidence.
