Apuntes sobre la democracia en un estado constitucional de derecho
This paper develops the most relevant aspects of the democratic constitutional state, rescuing aspects that identify it and necessary categories that configure it. In a constitutional state, it is relevant to talk about democracy as an element or necessary category of the constitutional state, to identify its features considering that the transition from the legal state to the constitutional state redefines the way of perceiving a society where the law has predominated as an instrument of organization and control, giving way to the constitution as a powerful instrument of control of power, which is often shown to be perverse and unlimited. The importance of the protection of fundamental rights is rescued, seeking to strengthen the citizen in his rights and his education with the purpose of weaving the virtuous friendship between the state and the citizen that significantly contributes to the control of power, development and strengthening of the democratic constitutional state.
