ORDONNANCE-LOI N°08-033 DU 12 SEPTEMBRE 1983 RELATIVE A LA POLICE DES ETRANGERS ET SON IMPACT SUR LE CONTROLE DE SEJOUR EN REPUBLIQUE DEMOCRATIQUE DU CONGO
ABSTRACT The national borders are the crossing points for foreigners, and essentially concern the border and frontier posts. At state level, the DRC government has entrusted the implementation of its migration policy to the Direction Générale de Migration (DGM), which is responsible for policing foreigners on national territory. This article begins by setting out the status of foreigners, then looks at the regulations governing entry to and exit from Congolese territory, and concludes with the role of the DGM in controlling the stay of foreigners on national territory. It is clear from these analyses that the meagre resources allocated by the government and its lack of support for this security service determine the poor results of residence control in the DRC. In this respect, the political authorities need to make good the lack of human resources in terms of training, logistics and technology, to ensure effective management and control of residence permits on their territory. Controlling the stay of foreigners is a proactive activity that reveals migratory pressure in the 21st century. If resources are insufficient or do not keep pace with the implementation of national migration policy, the "thermometer" will reflect a distorted image of the reality of irregular crossings, resulting in domestic insecurity and destabilization of the country's economic and social fabric. Keywords : Aliens police, residence control, foreigners, DGM.
