POR UMA MEMÓRIA DO DIREITO DE GÊNERO NO BRASIL: TOBIAS BARRETO, JOSEFA ÁGUEDA E A ASSEMBLEIA DO RECIFE

It is observed that in the memory of Brazilian law there is an episode that can be affirmed as a record of the emergence or origin of gender law, a political event with a social and educational foundation that seeks legal recognition. The text presented here aims to trace a sociological legal relationship between the framework of the Assembly of the Province of Recife and the origin of gender law in Brazil, with a focus on the actions and representation of Tobias Barreto and Josefa Águeda in the Assembly of Recife. In this fulcrum, it is pointed out that this initial kickoff is significant for the construction of a socio-legal literature on gender law, implemented in the light of a bibliographical research using a deductive method. Furthermore, the essay is based on an argumentative and exploratory methodology of a qualitative nature, since this approach is concerned with total immersion in the complexity of the social phenomenon explored. Thus, we propose a result anchored in the birth of gender rights in this context of legal struggle for female emancipation, for the fundamental social right to education, focusing on the Brazilian situation. And, in the space of debates on the legal issue of gender, this memory is not raised by Brazilian legal literature, hence the unequivocal relevance of this study.
