The Role of Notary Offices in Extra-Judicial Executions of Instruments in Brazil: a Reflection on Justice and Privatization

Objective: This article aims to analyze the role of notary offices in extrajudicial executions, exploring their legal and social implications for the Brazilian justice system. The aim is to understand how the delegation of traditionally state functions to the private sector contributes to the effectiveness of justice, especially in a context of overloaded Judiciary, and to examine the tensions between administrative efficiency and the principles of justice and accessibility. Theoretical Framework: The study is based on a legislative and doctrinal overview of extrajudicial executions in Brazil. The analysis considers the theoretical bases of the privatization of notary and registry services, as well as their connection with the principles of legal certainty, efficiency and equality. Renowned authors, consolidated case law and normative provisions were used to support the critical reflection on the role of notary offices in the context of extrajudicial executions. Method: The research adopts a qualitative, exploratory and descriptive approach, anchored in the deductive method. For the analysis, primary and secondary sources were used, including legal doctrine, case law and legislation, as well as case studies and relevant academic articles. The method seeks to integrate doctrinal and case law perspectives to offer a comprehensive and critical view on the subject. Results and Discussion: The results indicate that the role of notary offices in extrajudicial executions is essential to mitigate procedural delays and strengthen legal certainty. However, the privatized model raises questions about its compatibility with the democratic values of justice and accessibility, especially regarding the social impact of this delegation. The analysis of case studies and case law demonstrated a delicate balance between administrative efficiency and the fundamental principles of the Brazilian legal system. Research Implications: The investigation contributes to the academic and practical debate on the role of notary offices as agents in the execution of extrajudicial credits, highlighting the need for legislative and institutional adjustments to harmonize efficiency and justice. In addition, it provides support for the development of public policies that ensure accessibility and equity in the extrajudicial sphere, fostering dialogue between academia, legislators and legal practitioners. Originality/Value: This study advances the discussion on extrajudicial executions, a topic still incipient in Brazilian legal literature, by focusing on the role of notary offices from a critical and interdisciplinary perspective. By connecting the legal and social aspects of the privatization of notary and registry services, the research seeks to fill gaps in the literature and provide a robust reference for future studies and normative formulations.
