Exercise of the Right to Protection by a Person in Respect of Whom a Crime Report Is Beeing Verified: Criminal Procedure Regulation Issues

The article examines the problematic aspects of the participation of a defense attorney in criminal proceedings at the stage of initiating a criminal case, demonstrates the negative trends in law enforcement practice caused by the failure to ensure the right to defense of a person in respect of whom verification actions have actually been initiated during the consideration of a crime report, analyzes the approaches of the Supreme Court of the Russian Federation, the Constitutional Court of the Russian Federation in the sphere of exercising by such a subject of his right to defense,also analyzes the updated rules for determining payments within the framework of a lawyer's remuneration for the provision of qualified legal assistance at the stage of initiating a criminal case, approved by Government of the Russian Federation Resolution No. 796 of June 13, 2024, aimed at creating a legal basis for involving a defense attor- ney by appointment in criminal proceedings at the stage of verifying crime reports.
