On Some Ethical Risks of Professional Activity of Lawyers and Mitigation Means
In the article the author analyzes one of the central issues of the relationship between an advocate and a client — the ethical issue. Having analyzed the statistical data of the Russian Federal Bar Association, the author concludes that there is a fairly high number of violations of the norms of legislation on advocacy and the legal profession and the norms of professional ethics of an advocate, which are committed by young advocates and experienced advocates likewise. Having identified a number of reasons for unethical behavior of advocates, the author points out the negative consequences of such behavior and the risks to which both advocates who violate ethical standards and their clients are exposed. After analyzing the works of Russian and foreign researchers in this area, the author formulates a number of measures aimed at minimizing the ethical risks of the professional activities of an advocate.
