EQUIDADE DE GÊNERO NA GUARDA COMPARTILHADA: A IMPLEMENTAÇÃO DO PROTOCOLO DE GÊNERO DO CNJ E O CAPITAL INVISÍVEL INVESTIDO PELAS MÃES NA PENSÃO ALIMENTÍCIA.

This article explores an essential topic in family law: the pursuit of gender equity in shared custody. By analyzing the new CNJ Protocol for Judgments with a Gender Perspective, our goal was to uncover how this guideline has promoted a shift in recognizing the role of mothers. Women's non-financial contributions are often overlooked, particularly in calculating child support. Through a methodology based on bibliographic and documentary sources, this study aims to highlight the importance of this “invisible capital” in children's well-being and in the fair distribution of parental responsibilities. The results indicate that while the protocol has fostered transformation, challenges remain in fully recognizing women’s essential role. We conclude that a more sensitive and inclusive legal system depends on a new perspective on mothers' unpaid work, with suggested changes to foster a fairer and more equitable environment in both family and legal contexts.
