Tesi L’articolo esplora la disciplina giuridica applicabile al trust successorio, istituito con un atto inter vivos avente effetti post mortem, ed il trust testamentario, istituito mediante un atto post mortem, il testamento. L’analisi si concentra sulla disciplina giuridica applicabile ad entrambe le tipologie di trust, sottolineando le differenze tra la disciplina codicistica in materia contrattuale applicabile al trust successorio ed a quella in materia ereditario-testamentaria applicabile al trust testamentario. The author’s view The article explores the Italian legal framework applicable to a succession trust established by an inter vivos act with post-mortem effects and a testamentary trust created a post mortem act, i.e. a will. The analysis focuses on the legal framework applicable to both types of trust, highlighting the differences between the legal provisions in contractual matters applicable to a succession trust and those in inheritance-testamentary matters applicable to a testamentary trust.
