Juridical liability for failure to fulfill the child’s education obligations

In the Republic of Moldova, for the non-fulfillment or improper fulfillment by the parents or by the persons who replace them of the maintenance, education and training obligations of the child, contraventional liability arises. In practice, such liability was also applied when the child committed acts of violence against another child while in the custody of the educational institution. In any case, the responsibility for the non-fulfillment or improper fulfillment of the educational obligations, when the fact is manifested by the problematic behaviour of the child at school, must be determined according to the cause of the behaviour. The liability of the parents or the persons who replace them must intervene as a last resort, that is, if other remedies are not able to achieve the intended goal.
