CRITÉRIOS NA QUANTIFICAÇÃO DO DANO MORAL SOB O VIÉS DA REFORMA DO CÓDIGO CIVIL E A JURISPRUDÊNCIA DO TJPA
The article examines the standards and challenges related to the quantification of moral damage, with an emphasis on brazilian doctrine and the jurisprudence of the Court of Justice of Pará (TJPA). The research explores the different possible standards to more objectively measure moral damage, and discusses the applicability of the two-phase method as a proposal to standardize the quantification of compensation for moral damage, promoting greater equity and predictability in decisions. Furthermore, the study evaluates proposals to reform the Civil Code, which seeks to consolidate very clear guidelines to guide the judge in assessing the damage. The analysis also reveals trends in the TJPA jurisprudence, pointing out how the reform can contribute to reducing subjectivity and disparity in decisions to set the compensation quantum.
