DIREITO DAS VÍTIMAS DE EXTORSÕES CIBERNÉTICAS: UMA ANÁLISE DOS MECANISMOS DE PROTEÇÃO E APOIO ÀS VÍTIMAS NO SISTEMA JURÍDICO BRASILEIRO

This work aims to analyze the protection and support mechanisms offered to victims of cyber extortion in Brazil, in the light of the current legislation and the resources available in the legal system. The study is based on a qualitative analysis, focusing on secondary data, court decisions and bibliographic reviews on applicable legislation and legal practice. The research also includes a comparative analysis with other jurisdictions, such as the United States and the European Union, which have more advanced mechanisms to combat cybercrime. With the growing number of cybercrimes, the Brazilian legal system tries to respond to the needs of victims through legal tools, psychological and social support. However, gaps in legislation and its practical implementation persist, which hamper the effectiveness of the system. This work proposes reforms to ensure greater effectiveness in the protection and recovery of victims. Consequently, the research approach was sought by examining legislation, bibliographic sources and doctrinal materials to achieve better results.
