CONTRADICTION IN THE ROLE OF REGIONAL VICE HEAD WITHIN THE REGIONAL GOVERNMENT SYSTEM: AN ANALYSIS OF LAW NO. 23 OF 2014 ON REGIONAL GOVERNMENT
The role of the deputy regional head is primarily complementary to that of the regional head, with their main responsibility being to assist the regional head in carrying out their duties. However, the ambiguity surrounding the deputy’s authority is a significant factor contributing to the disharmony between regional heads and their deputies. If this issue remains unaddressed, it may lead to further complications. This concern has led to discussions about the potential elimination of the deputy regional head position altogether. This study adopts a normative juridical approach, using secondary data analyzed through qualitative juridical methods to produce a descriptive narrative. The findings indicate that, in practice, the regional head’s role often overshadows that of the deputy, leaving the deputy regional head with little meaningful authority. This imbalance frequently results in strained relationships between the two offices. To enhance the effectiveness of regional governance, efforts to strengthen the deputy regional head's authority are essential. One potential solution is the implementation of a Principle-Based Authorization Model, which could provide a clearer framework for the deputy’s role. It is recommended that the government and parliament adopt this model to empower the position of the deputy regional head. This would require amendments to Law No. 23 of 2014 on Regional Government or the enactment of specific regulations detailing the responsibilities of the deputy regional head.
