PENERAPAN PRINSIP MENGENALI PENGGUNA JASA OLEH PPAT DALAM RANGKA PENCEGAHAN TINDAK PIDANA PENCUCIAN UANG

Abstract The issuance of PPATK Head Regulation No. 11/2017 on the Principle of Recognizing Service Users by PPAT requires PPAT to report suspicious transactions to PPATK. However, this obligation conflicts with the PPAT's duty to maintain the confidentiality of the deed, including the identity of the parties involved, as stipulated in the PPAT's oath of office. On the other hand, PPATs also face difficulties in implementing the obligation to report suspicious transactions because good relationships with service users must be maintained, and reporting suspicious transactions may risk damaging the reputation of service users. This study aims to analyze the factors that make it difficult for PPATs to implement the Principle of Recognizing Service Users to prevent money laundering, as well as the legal implications for PPATs who do not comply with these provisions. The results show that the main difficulty lies in proving the testimony of the service user and the fear of defamation charges. In addition, higher regulations, such as Government Regulation No. 37 of 1998 jo. PP No. 24/2016, which stipulates that PPAT's obligation to keep information confidential dominates compared to PPATK Head Regulation No. 11/2017. The legal consequences for PPATs who do not apply the Principle of Recognizing Service Users can be in the form of administrative sanctions, in accordance with Articles 31-35 of the Head of PPATK Regulation No. 11 of 2017.
