DIREITO AO ESQUECIMENTO E AS DIFICULDADES DO APENADO PARA RESSOCIALIZAÇÃO NA SOCIEDADE BRASILEIRA
The article addresses the right to be forgotten in the Brazilian context, exploring its implications for privacy, human dignity, and the control over individual memory in a society marked by the digital massification of information. The study aims to analyze how the right to be forgotten is manifested in high-profile cases, such as those of Suzane von Richthofen and Xuxa Meneghel, where prolonged exposure interferes with the right to start anew and social reintegration. Using a theoretical and analytical approach, the study examines the conflict between the right to privacy and freedom of information, emphasizing the need for a balance between access to information and the protection of individuals' honor and privacy. The article concludes that the right to be forgotten, when applied in a balanced manner, represents an essential extension of the right to privacy, ensuring that individuals can rebuild their lives without being eternally associated with specific episodes. The study further highlights the importance of a specific regulatory framework for the right to be forgotten in Brazil, which could reduce legal uncertainty and provide clear guidelines for cases of prolonged exposure, fostering a society that is more just and respectful of individual dignity and autonomy.
