O ENFRENTAMENTO DA VIOLÊNCIA CONTRA A CRIANÇA E O ADOLESCENTE APÓS A LEI N° 14.344/2022 (LEI HENRY BOREL)
This article addresses Law No. 14.344/2022, known as the Henry Borel Law, enacted to strengthen the protection of children and adolescents who are victims of domestic violence. Initially, it discusses the concept of child violence, identifying its various forms— physical, psychological, sexual, and neglect—and their implications for the victims' development. The study analyzes the context of the law's creation, motivated by the need for a more effective legislative response following emblematic cases of violence, such as that of the boy Henry Borel, and details the main provisions of the legislation, including protective measures and penalties for aggressors. The research also explores the impacts of the Henry Borel Law, highlighting the strengthening of the protection network and social awareness about child violence. However, the article discusses the challenges faced in implementing the law, such as the lack of infrastructure and resources, the disarticulation between protective agencies, and cultural barriers that hinder reporting and addressing violence. It concludes that despite the significant advancements provided by the Henry Borel Law, its effectiveness depends on a collective commitment between the state and society to overcome the practical and cultural limitations that still persist in combating violence against children and adolescents. The scientific article emphasizes the importance of a continuous effort to ensure a safe and healthy environment for the development of future generations.
