ANÁLISE SOBRE HERANÇA DIGITAL E A IMPORTÂNCIA DA REGULARIZAÇÃO JURÍDICA

The digital legacy, consisting of the data and digital assets that individuals leave after their death, is a topic that is becoming increasingly relevant in the digital age. This article provides an analysis of the importance of the succession of intangible digital assets. Aspects such as the definition and meaning of digital inheritance, its absence in legislation and relevant issues regarding its applicability are discussed, considering both supporters and opponents of digital inheritance. We also explain what hereditary succession is in Brazil and how it occurs according to court, decisions and precedents, as well as how cases involving the succession of digital assets are currently resolved. Thus, contributing to a better understanding of the application of inheritance rules to specific cases of digital inheritance and to legislative projects under consideration in the Chamber of Deputies to amend the 2002 Civil Code.
