Constitutional and legal regulation of the right to file petitions and complaints to the Kuwait national assembly

The objective of this study is to address the constitutional and legal regulation of the right to submit petitions and complaints to the Kuwaiti National Assembly. This right has been stipulated in Article (115) of the Kuwaiti Constitution issued in 1962 AD, when it mandated the National Assembly to form a committee, within its annual committees, to be specialized in examining petitions and complaints submitted by Kuwaiti citizens to the National Assembly. Also, Article (45) of the Constitution stipulates that the individuals are entitled to address the three public authorities, including, of course, the legislative authority. Despite the cruciality of that right, yet the constitutional jurisprudence in Kuwait has not paid much attention thereto; researches or studies are very rare in this matter. Stemming from that was our interest in this subject and, hence, this study, where we adopted a descriptive and analytical approach to the constitutional texts, legal texts and the minutes of the National Assembly and its committees. We have dealt with that subject in three topics: the first deals with the nature of petitions and complaints and the right to submit them to the National Assembly, the second explains the method of exercising the right of submitting petitions and complaints and the mechanism of work of the Petitions and Complaints Committee and the last topic deals with the settlement of petitions and complaints.
