IMPROBIDADE ADMINISTRATIVA E A PERDA DA FUNÇÃO PÚBLICA POR MILITARES DAS FORÇAS ARMADAS

Of the Acts of Administrative Improbity, Law No. 8,429/92 which provides for sanctions applied due to the practice of acts of administrative improbity, in its twentieth article explains the consequent loss of public service, however, when applied to military personnel in the Armed Forces it is I put its effectiveness to the test, due to the specificities of the military sphere and it leaves some gaps related to the legal issue, fueling doubts such as those that will be addressed throughout the article. Another dilemma in Administrative Law will be consolidated: compliance with the recommendation of Administrative Improbity with regard to the military contingent. We will discuss below the consequent loss of public service and the implications for judging the loss of rank and rank or graduation of military personnel in the Brazilian Armed Forces.
