Vještačka inteligencija i pravna zaštita dizajna
The paper deals wiht legal consequences of the application of artificial intelligence in the process of creating a design. Artificial intelligence is used in all segments of life and opens up new opportunities in different areas of creativity. Design means the appearance of the whole or a part of a product and it can be created with the help of artificial intelligence or by artificial intelligence, so we have AI-assisted designs and AI-generated designs. If the design is completely generated by an artificial intelligence system, if there is no input from the designer, such a design cannot be protected by intellectual property law because it is not a human creation. If the designer has used artificial intelligence as an aid, there is a possibility of protection if it is his own contribution, which has to be assessed on case by case basis. The consequences of using a protected design in the process of „training“ an artificial intelligence system are analyzed. Considering the fact that the design can be protected in copyright and design protection law, the similarities and differences between the two forms of protection were pointed out. Finally, an overview of the most significant theoretical approaches on the issue of protection of intellectual creations created using artificial intelligence is given.
