Uloga veštačke inteligencije u međunarodnoj trgovinskoj arbitraži

Artificial intelligence has already made its way into many fields of social life. It is undoubtedly already present in international commercial arbitration as well. Some AI systems of general application, such as ChatGPT and Siri, may perform certain tasks that could be used in the field of international commercial arbitration. In addition, specialized software, intended specifically for use in the field of alternative dispute resolution, is being developed almost on daily basis. For the time being, the key tasks that can already be entrusted to artificial intelligence are legal research, facilitation of some stages of the proceedings and production and presentation of evidence. However, considerable efforts are invested into examining and creating the possibilities for using artificial intelligence as an independent decision-maker in some specific types of proceedings, a facilitator of some non-adjudicative ADR methods (e.g. negotiations aimed at reaching the settlement) or even a digital counsel (e.g. the DoNotPay system). This paper will present and analyze the current state of use of artificial intelligence in international commercial arbitration, explore the potential for its wider use and offer one of the possible visions of the future of artificial intelligence in international commercial arbitration.
