Veštačka inteligencija i povrede konkurencije
In recent years, there has been a noticeable increase in interest from both the academic and business communities regarding diverse applications and impacts of artificial intelligence. Nonetheless, artificial intelligence and its implementation in business practices is a phenomenon with which professional advisors in the realm of antitrust have been well-acquainted for the past decade. In this context, the authors of this paper present the fundamental tenets of competition law and artificial intelligence within the digital milieu, emphasizing the convergence of these two evolving domains. Subsequently, the authors highlight the challenges faced by watchdogs concerning artificial intelligence and analyze the growing trend of using modern technologies in antitrust enforcement. The paper concludes with an overview of recent regulatory developments at the European Union level concerning digital markets and artificial intelligence, with particular attention on the Digital Markets Act and the Artificial Intelligence Act, which the authors identify as having the greatest potential for long-term shaping of the competitive landscape in markets affected by artificial intelligence.
