THE USE OF ENGLISH IN INTERNATIONAL ARBITRATION: CHALLENGES AND OPPORTUNITIES
Language is one of the main ways of communication. Everyone is well aware of the Bible story of the Tower of Babel, which tells of ancient times when people spoke the same language. They wanted to build a tower to the sky to be on a par with God. But God did not allow them to finish it, making them speak different languages. So, because of misunderstanding each other, the people began to divide, and the construction was not completed. There is also an expression “we speak different languages”. It means that there is no understanding. A common language is very important in building relations between nations. It is the development of political, social, economic, and other promising relations. Today, more than 50% of the world’s population can speak two or more languages, and more than 1.5 billion people who learn a second language prefer English [2]. Therefore, it is very important for Ukrainians to learn this language. And if we consider the ECHR as a great organization that helps all people regardless of their country, faith, or political views, we can see that all cases are conducted in English or French. Therefore, a high level of language proficiency is required to better understand the entire judicial decision-making process. We cannot ignore international arbitration, where the issue of the language of the court proceedings is also resolved in favor of English.
