Medical Care in Axio-Teleological Interpretation (Based on the Materials of the Constitutional Judicial Practice)
The article analyzes the relationship between applied medical care and constitutional and legal guarantees of its provision, as well as the role of different types of legal proceedings in ensuring the right to medical care. The authors focus on axio-teleological interpretation as the main method of constitutional justice. Specific examples of the axioteleological interpretation of medical care in relation to other constitutional values are given. As a result, conclusions were drawn confirming that the axio-teleological interpretation of medical care allows one to actually literally evaluate the constitutionality/unconstitutionality of a controversial legal provision in the medical field, as well as the practice based on it.
