PROBLEMS OF CONSOLIDATION AND IMPLEMENTATION OF THE ADMINISTRATIVE LIABILITY FOR THE FAILURE TO USE CASH REGISTER EQUIPMENT
The article deals with problematic issues of regulatory regulation and the implementation of administrative responsibility for the non-use of cash registers. A contradiction has been revealed between the norms of the General and Special parts of the Code of Administrative Offences of the Russian Federation (hereinafter referred to as the Administrative Code of the Russian Federation, the Code) in terms of determining the amount of a fine for the specified offense. The authors assess the approaches to sentencing established in law enforcement practice under part 2 of Article 14.5 of the Administrative Code of the Russian Federation, substantiate the position on the nature of the correlation of the norms of the General and Special parts of the Code, formulate a conclusion on the need to eliminate the identified conflict, argue for their proposed method of solving the problem under study.
