Specifics of Inheriting by Children Conceived and Born a Result of Posthumous Reproduction Programs Implementation

The practical application of posthumous reproductive programs, in which the conception and birth of a child (children) occurs after the death of the parents or one of them, has led to the possibility of new potential heirs appearing some time after the death of the testator (potential parent or potential parents). In this article, the author examines the legal status of "postmortem" children, both in domestic and foreign inheritance law. Based on the analysis of the norms of current domestic and foreign legislation, the author concludes that it is necessary to improve the current Russian legislation in the field of inheritance rights in the implementation of posthumous reproduction.
