Use of Evidence Referred to the “Restricted” Category by an Antimonopoly Authority
The article deals with the aspects of failure to provide persons with documents classified as “For Official Use” for familiarization during consideration of cases on violation of antimonopoly legislation and proceedings on cases of administrative offenses related to violation of antimonopoly legislation. It is noted that until the“For Official Use” decategorized is removed from the materials submitted in the case, the antimonopoly authority has no legal grounds for granting a request to familiarize itself with a document constituting a legally protected secret. The author proposes a possible way to solve the problem.
