On the Expediency of Establishing Authorities for Solving Intradepartmental Economic Disputes: The Problem Setting Approach
The author proceeds from the premise that there is an exorbitant and increasing burden on judges of almost all jurisdictions and all links of the judicial system - if it is impossible to adequately increase the composition of the judiciary and limit the possibilities of simplifying legal proceedings in many categories of cases, as well as transferring a number of court cases to the notary. He believes that one of the ways to solve this problem can, in principle, be the creation of a system of departmental courts that resolve economic disputes arising from civil legal relations between the business structures of one ministry, department, state corporation, concern, etc. multicomponent economic education. He believes that, for various reasons, such disputes are currently not in all cases, for various, obvious reasons, they are referred to arbitration courts, due to which these contrasts of the positions of the disputing parties remain latent or are resolved by illegal means, which does not contribute to ensuring justice in these relations. An example of the proposed judicial bodies can be departmental arbitrations, which, along with state arbitrations during the Soviet era, were an effective organizational and legal mechanism for resolving economic disputes: in the first case, between the economic authorities of the same economic ministry (department), in the second, different ones. The author emphasizes that this proposal is only the first approach to solving this problem, which requires serious and deep scientific study.
