Legal Regulation of the Inter-University Quantum Communication Network
According to the Concept of Technological Development for the period up to 2030, quantum communications are included in the list of end-to-end technologies (technological directions), which should be supported by public authorities in the Russian Federation. This is a new type of information technology, the potential of which for data protection and information transfer in our country has not been fully realized. In order to stimulate research in this area, as well as attract young scientists to the development of technologies, in 2023 it was decided to create an interuniversity quantum communication network that will unite several domestic universities and allow testing experimental and commercial prototypes in the field of quantum communications and quantum cryptography. To date, the full-fledged operation of the network has not been carried out, the reason for which, as the study showed, is the presence of a number of legal barriers that complicate access to the network, as well as unnecessarily bureaucratize its commercial operation. As part of the analysis of the current legislation, it was concluded that it is not possible to change the legislation for the interuniversity quantum communication network in the medium term, which made it possible to put forward and justify a proposal to create an appropriate experimental legal regime in the field of digital innovations. The author analyzes the legislation that applies to public relations arising in the field of quantum communications, and proposes elements of a special legal regime for an interuniversity quantum communication network.
