Powers of the Head of a Peasant (Farm) Enterprise to Dispose of Common Property: The Essence and Limitation Mechanisms

The article contains a detailed analysis of the subjective aspect of the disposal of common property belonging to members of a non-subject peasant (farm) enterprise, first of all, in terms of the (in)expediency of the model «the proper subject of disposal is exclusively the head of the enterprise», as well as the (un)justified characterization of the actions of the head as representative; the author proves the relevance of not only contractual, but also centralized regulation of relations related to limiting the powers of the named person (through the introduction of a mechanism for mandatory obtaining the consent of members of the farm to carry out certain administrative acts, etc.).
