O MEDO NO DIREITO ADMINISTRATIVO E O APAGÃO DAS CANETAS: IMPACTOS DO SISTEMA DE CONTROLE NA EFICIÊNCIA DA GESTÃO PÚBLICA
This article analyzes the impact of excessive control and punitive power exercised over the actions of the Public Administration, which results in inefficiency in public management and, in many cases, in decision-making paralysis, known as “pen blackout” or administrative silence. The investigation addresses how the fear of severe sanctions discourages managers from making decisions that involve discretion and innovation, compromising efficiency and the fulfillment of public objectives.
