Permafrost Degradation: Legal Consequences
This article identifies current problems of permafrost degradation in the context of the emergence of a new sphere of legal regulation, primarily in Russia as a subarctic country. Various legal consequences of this phenomenon, especially those arising outside the sea, on land, are very sensitive to ecosystems and humans. It is proposed to begin solving emerging economic and legal problems by improving the legal regime of rights to land plots and real estate located on them, identifying a range of special and modified environmental law institutions applicable to the special conditions of permafrost. Particular attention is paid to new problems and gaps in land and civil law in the regulation of permafrost. A number of areas of legislation need adaptation to new realities.
