The issue of severity of liability in case of repeated administrative offenses in the utility sector according to legislation of Georgia

Administrative offenses in the utility sector include various law violation types related to crimes committed in the electricity, natural gas, and water supply sectors. Such violations are primarily regulated by special legislation adopted by the Parliament of Georgia and the regulatory body. After the legislative body adopted the new law "On Energy and Water Supply" on December 27, 2019, a legal framework was created in Georgian legislation to consider and implement the requirements of various legal acts of the European Union. The Code of Administrative Offenses of Georgia was adopted in 1984 and no longer meets modern requirements. Therefore, it is frequently amended, and various articles have been discussed by the Constitutional Court more than once. The article will talk about such inappropriate articles and the decision made by the Constitutional Court, which has been the subject of consideration by the Constitutional Court since 2018. The final decision was made on June 14, 2024, based on which the Parliament of Georgia will have to develop the content of a new legal norm in the spring of 2025.
