Constitutional rulings 34 and 49/2023 mark a significant shift in constitutional jurisprudence that affects education differentiated by sex and based on the functional diversity of the individual, as a consequence of the most recent educational reform promoted by the LOMLOE. Barely five years after having ruled on its full constitutional fit, an ideological conception of the educational system inspired by constitutional values now closes the means for public financing of the former and assumes a preference for the most inclusive regime within the system in the second, limiting the rights of families in both cases. A controversial judicial decision that not only narrows the margins of educational pluralism but may end up undermining the essential content of constitutionally recognized educational freedoms.
