O IMPEDIMENTO DO JUIZ PROLATOR DA ABSOLVIÇÃO SUMÁRIA EM RAZÃO DA REFORMA DA SENTENÇA EM SEDE DE APELAÇÃO

The present work addresses the possibility of impediment of the criminal judge issuing a summary acquittal that has been reformed by the court so that the case can be returned to the procedural investigation in its court of origin. Examines the merit behind a summary acquittal sentence and its importance within criminal procedural logic. It focuses on the implicit constitutional principle of impartiality, as well as breaking down each of the legal causes of suspicion and impediment that we currently have in our legislation. It thus questions the necessary legislative implementation of the reason for impediment presented in this article as a way of safeguarding due process where there is no judge riddled with bias.
