On the List of Persons Who Can be Admitted as Legal Representatives of Juvenile Participants in Criminal Proceedings
The list of persons who may be admitted as legal representatives of a minor suspect, accused or a victim, is enshrined in paragraph 12 of article 5 of the Criminal Procedure Code of the Russian Federation and is exhaustive. This norm has been repeatedly subjected to critical analysis, and proposals have been made to expand the list of possible legal representatives enshrined in it. The author analyzes some proposals and concludes that it is necessary to retain the established list, and also proposes measures to improve the work of guardianship and tutelage clerks when they represent minor participants in criminal proceedings.
