LEGAL CONSCIOUSNESS OF LAWYERS IN A STATE OF MILITARY LAW
The article explores the legal consciousness of lawyers during a state of war, emphasizing the importance of professional ethics and moral values in their activities amidst armed conflicts. Specific challenges faced by lawyers in wartime conditions are analyzed, including threats to physical safety, limitations on access to clients and legal information. Special attention is given to the role of lawyers in defending human rights and upholding the rule of law in extraordinary circumstances. Legal and ethical principles governing lawyers' behavior during wartime, as well as the importance of maintaining a high level of legal awareness to ensure fair justice, are highlighted. Based on the conducted research, recommendations are formulated to strengthen lawyers' legal consciousness, enhance their resilience, and improve effectiveness in times of war. A comparative analysis was applied to identify changes in the legal consciousness of lawyers before and during the state of war. It was found that during the state of war, lawyers become more aware of their social responsibilities, ethical obligations, and the need to protect human rights even in conditions of limited resources and increased risk. It has been established that the state of war significantly impacts the work of lawyers, forcing them to adapt their working methods and approaches to client protection. For instance, restrictions on movement, the risk of physical threat, and the influence of wartime propaganda create additional challenges. The analysis showed that during the state of war, lawyers often face ethical dilemmas, such as choosing between professional duties and personal safety. An important aspect is the adherence to the principles of confidentiality and impartiality in conditions of heightened tension.
