1969 Vienna Convention

Abstract This chapter studies Article 42 of the 1986 Vienna Convention on the Law of Treaties (VCLT), which deals with the validity and continuance in force of treaties. Apart from the additional reference in its first paragraph to international organizations, Article 42 of the Vienna Convention of 1986 reproduces word for word Article 42 of the Vienna Convention of 1969. The commentaries to the latter are therefore applicable to the present Article. One can nonetheless query whether certain grounds for invalidity of treaties admitted by States, relative notably—though not exclusively—to the grounds vitiating consent, can be transposed to international organizations. This is considered in the commentaries to each of the relevant Articles.
