Výjimečný trest v procesu reformy trestního práva hmotného
An exceptional punishment means a sentence of imprisonment of fifteen up to twenty-five years and life imprisonment. It was introduced into the Czech Criminal Code in 1990 when the former exceptional death penalty was abolished. This presentation deals with the changes of legal regulation of the exceptional punishment in the process of criminal law reform which consists of two phases. The first one is the phase of amendments, the second the phase of recodification. The author maps and analyses the most important amendments of the Criminal Cod and Code Criminal Procedure relating to the exceptional punishment and deals also with the bill of the new Criminal Code. She gives some recommendation to this bill as to the future form of the exceptional punishment.
